Woman who Thought she Became Nidda

My wife saw what she thought was blood and told me that she is a niddah. upon going to the gynecologist it was discovered that it was def not blood rather an infection that needed antibiotics. the question is if she is now a niddah after she erroneously called herself one or is she clean. (this is not in the 7 clean days. she went to mikva a week ago).

Answer:

Under the circumstances there is no problem and your wife is permitted.

The halachah is that if a woman says that she is tamei (saw blood), and then says that she is tahor (she made a mistake), if she can explain why she initially made a mistake (give an “amatla”) she is believed and permitted to her husband (see Kesubos 22a; Shulchan Aruch, Yoreh De’ah 185:3).

This is certainly the case over here, where the reason for the mistake is clear cut and known to husband and wife as one.

Although if a woman does a “maaseh” which demonstrates before others that is a Niddah, such as wearing specially designated clothes, this can change the halachah – this idea will not generally apply today (when women don’t wear such clothes) and will also not apply to our case.

See Shut Divrei Chaim 1:32 who explains that wearing specially designated clothes is a “testimony before others” that she is a Niddah, and she therefore cannot retract her testimony; see also Shut Chasam Sofer, Yoreh De’ah 87. In our case, the mistake is clear to all, and in this case even witnesses will be able to retract their testimony (see Shulchan Aruch, Choshen Mishpat 29:1).

Therefore, there is no concern for any prohibition.
